Booking
Reservation Details: Clients are encouraged to provide a written and numbered purchase order when scheduling studio time. This purchase order should specify: The exact amount of studio time requested, and the names of individuals authorized to book additional time.
Authorization: In cases where a client opts to forego a written purchase order, they authorize producers, artists, or other project participants to incur charges on their behalf. The client waives any claim that these charges were unauthorized.
Termination of Work: To discontinue or cancel ongoing work on a project, the client must provide Nothingbuthit Records LLC with a written notice.
Payment
Payment Arrangements: All special payment arrangements must be authorized in writing by Nothingbuthit Records LLC at least three (3) business days before the session.
Insufficient Funds & Unauthorized Credit Cards: Payments made by check with insufficient funds or via unauthorized credit card are considered unpaid.
Overdue Balances & Fees
A $75.00 processing fee will be charged for overdue invoices, and unpaid balances may be turned over to collections.
The client is responsible for all collection costs.
A carrying charge of fifteen percent (15%) per month, calculated from the invoice date, will be applied to all amounts more than thirty (30) days past due.
Retention of Recordings
Nothingbuthit Records LLC reserves the right to retain recorded media until full payment, including any associated fees, has been received.
Down Time: Any lost time resulting from equipment issues, operator errors, or media defects is considered “DOWN TIME.” No financial compensation for down time will be granted unless specifically indicated on the work order.
Cancellation & Rescheduling
No Cancellation Policy: Once a session is booked, clients who cancel or request to reschedule will forfeit any payments made.
New Bookings: To secure a new session date, a separate payment must be provided in full.
Fraudulent or Stolen Funds
Zero-Tolerance Policy: Nothingbuthit Records LLC strictly prohibits any use of stolen or fraudulent payment methods, in line with federal law.
Client Responsibility: By providing payment, the client guarantees that the payment source and identification are legitimately theirs.
Legal Consequences: Any attempt or successful use of fraudulent methods, including theft, may subject the client to legal action.
Waiver of Liability
Injury & Damages: The client voluntarily releases Nothingbuthit Records LLC from any liability associated with personal injury or property damage that may occur on the premises.
Financial Responsibility: The client assumes full financial responsibility for any costs or damages they, or anyone under their direction, cause.
Indemnification: The client agrees to defend, indemnify, and hold harmless Nothingbuthit Records LLC—and its managers, officers, employees, volunteers, agents, successors, or assigns—against any claims, losses, or liabilities arising from injuries or damages incurred at the studio.
Down Time Expenses: Nothingbuthit Records LLC is not responsible for additional costs (e.g., musician or vocalist fees) associated with any down time.
Property
Storage Duration: Recorded media left with Nothingbuthit Records LLC for more than one (1) month may be subject to storage or shipping fees.
Assumption of Risk: Clients agree to indemnify and hold Nothingbuthit Records LLC harmless for any damage or loss to their equipment or recorded media during storage, handling, or shipment.
Notice of Video Recording
Our studio is under 24/7 video surveillance for our clients' safety.
General Provisions
Non-Transferable: Clients may not assign or transfer any rights or responsibilities under this agreement without prior written consent from Nothingbuthit Records LLC.
Legal Fees: If legal measures are necessary to enforce these terms, the client agrees to cover all reasonable attorney fees and court costs incurred by Nothingbuthit Records LLC.
Jurisdiction: This agreement is governed by the laws of the State of California (or the applicable jurisdiction).
Modification: Any changes or additions must be documented in writing and signed by both the client and Nothingbuthit Records LLC.
Scope: These terms apply to all current and future services and bookings between the client and Nothingbuthit Records LLC.
